Introduction

This Privacy Notice describes how Foreveries ("we," "us," or "our") collects, uses, and discloses information, including personal data, obtained through our mobile application ("App").

The data controller is Salvatore Pelligra, Munich, Germany, reachable at support@foreveries.eu.

Information We Collect

We collect the following information through the App:

  • User ID, assigned at signup, it uniquely identifies the user within the App.
  • Full Name, for personalized messages and user recognition.
  • Email address, for authentication purposes.
  • Content (such as photos, videos, and text). Users may upload Content depicting themselves and others with their prior consent. We are not responsible for obtaining consent on behalf of users. Uploading Content depicting others without their consent may have legal implications and violate applicable laws.

Logs

We collect diagnostic logs to ensure we can effectively resolve issues in case an error occurs while using the App. Logs are stored encrypted on our servers, located within the European Union, and are automatically deleted after 60 days.

The information stored in logs includes:

  • IP address
  • Device model
  • Operating system version
  • App version
  • Internal identifiers (such as User ID, Album ID, or Media ID)

Legal Basis for Processing

We process your personal data on the following legal bases under the General Data Protection Regulation (GDPR):

  • Contract performance (Art. 6(1)(b) GDPR): Processing of your account data (User ID, name, email address) and Content is necessary to provide the App and its functionalities.
  • Legitimate interest (Art. 6(1)(f) GDPR): Collection and processing of diagnostic logs is based on our legitimate interest in maintaining the reliability and security of the App. You have the right to object to this processing (see Your Rights below).

How We Use Your Information

We use the information we collect for the following purposes:

  • To provide and improve the App and its functionalities.
  • To personalize your experience within the App.
  • To authenticate users and ensure account security.
  • To communicate with you about your account and the App.
  • To diagnose and resolve technical issues (logs).

Sharing Your Information

We do not sell your personal data.

The only third party that processes personal data on our behalf is Scaleway S.A.S. (Paris, France), which sends transactional emails on our behalf. Scaleway processes your email address solely for the purpose of delivering these emails and is bound by a Data Processing Agreement. All processing occurs within the European Union.

Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes described in this Privacy Notice.

  • Diagnostic logs are automatically deleted after 60 days.
  • Account data and Content are retained for as long as your account is active.
  • Once you delete your account, all your personal data, including logs, will be deleted, except for any information we are required to retain by law.

Your Rights

Under the General Data Protection Regulation (GDPR), you have the following rights regarding your personal data:

  • The right to access your personal data.
  • The right to rectify inaccurate personal data.
  • The right to request erasure of your personal data.
  • The right to restrict the processing of your personal data.
  • The right to data portability.
  • The right to object to the processing of your personal data based on legitimate interest.
  • The right to lodge a complaint with a supervisory authority. The competent authority is the Bayerisches Landesamt für Datenschutzaufsicht (BayLDA), Promenade 18, 91522 Ansbach, Germany (https://www.lda.bayern.de).

Provision of Personal Data

Providing your name and email address is necessary to create an account and use the App. If you do not provide this information, you will not be able to use the App.

The collection of diagnostic logs is automatic while using the App. You may exercise your right to object to this processing by contacting us (see Your Rights), in which case we will assess whether our legitimate interest in maintaining the App's reliability overrides your objection.

Automated Decision-Making

We do not use automated decision-making or profiling based on your personal data.

Security

We implement appropriate technical and organizational measures to protect your personal data from unauthorized access, disclosure, alteration, or destruction. All data is stored encrypted on servers located within the European Union. However, no security measures are perfect, and we cannot guarantee the absolute security of your information.

Children's Privacy

Our App is not directed to children under the age of 16. We do not knowingly collect personal data from children under 16. If you are a parent or guardian, and you learn that your child has provided us with personal data, please contact us.

Changes to this Privacy Notice

We may update this Privacy Notice from time to time. We will notify you of any changes by posting the new Privacy Notice on the App.
